Photo Conference

Release, Risk Assumption, Arbitration & Knowing Execution

Liability Release:

By attending a workshop, meetings and/or outings organized with/or by the Niagara Frontier Regional Camera Club at the Niagara Frontier Regional Camera Club Photo Conference I acknowledge that it is not without risk.  I agree that Niagara Frontier Regional Camera Club and its directors, officers, agents, or assigns will not be held liable for injury, illness, accident, medical emergency, death or other related problems arising from the “Event” to myself, including any participants(s) under the age of 18.  I also agree to hold the Niagara Frontier Regional Camera Club and its directors, officers, agents, or assigns will not be held liable in the event I suffer equipment theft, damage or lose; film theft, damage or loss; memory card theft, damage or loss; data loss; and/or the loss of any other personal property while attending the “Event”.  I agree that the Niagara Frontier Regional Camera Club and its directors, officers, agents, or assigns are not liable for acts by humans or of God that may occur during the “Event”, including but not limited to: severe weather, earthquakes, war terrorism, riot or other civil unrest.

Assumption of Risk:

As a participant in the “Event”, I acknowledge that I am expected to be in normal health and am willing to be responsible for my own actions.  While the Niagara Frontier Regional Camera Club takes reasonable precautions to ensure a problem-free event, and although problems are extremely rare, photography events are not risk-free.  I acknowledge that my participation in the “Event” constitutes an awareness and acceptance of these risks.  I assume complete and total responsibility for my own health, safety and well-being while attending the “Event”.

Binding Arbitration:

I agree that any dispute relating to this Release and Assumption of Risk shall be resolved exclusively by binding arbitration according to the then existing rules of the Local Jurisdiction in which the “Event” occurs.  Such proceedings will be governed by substantive law of the local jurisdiction in which the “Event” occurs excluding any application or consideration of the local jurisdiction in which the “Event” occurs.

Knowing and Voluntary Execution:

I have carefully read and fully understand the contents and legal ramifications of this Liability Release, Assumption of Risk and Arbitration Agreement.  I understand that this is a legally binding and enforceable contract, and I sign it of my own free will.  I agree that if any portion of this agreement is found to be void and unenforceable, the remaining portions shall remain in full force and effect.

Cancellation By You:

  • 30 days or more before convention, receives a full fee refund.
  • 29 days or less before convention cancellation, no refund. In the case of extenuating circumstances, refunds will be decided on a case-by-case basis.

Cancellation/Changes By Us:

We are not responsible for cancellation due to unforeseen events that are beyond our control. In the unlikely event of the Photo Conference being cancelled by us, all monies paid will be refunded. That is the limit of our liability. We limit our liability for changes in our speaker presentations. We are not responsible for any expenses you incur including non-refundable airline tickets or any other costs.

Speaker Series

The NFRCC Speaker Series is presented as an online web-based event. The NFRCC and the scheduled speakers agree to fully commit to the date and time of the presentations. In the event of sudden illness of the speaker, power outage, or internet outage, the NFRCC and speakers will first make their best efforts to reschedule the event to a mutually acceptable time frame.

In the event a program needs to be rescheduled and an attendee purchased a single event only admission for that program being rescheduled and cannot attend at the rescheduled date and time, the NFRCC will, upon request, refund the purchase price or issue a credit for a different Speaker Series program.

In the event the NFRCC must permanently cancel a scheduled program, the NFRCC will:

  • For a single event purchase, offer a credit for another speaker program or refund the single event purchase price.
  • For a full season purchase, upon request, issue a pro rata refund for the cancelled event.

Refunds due to extenuating circumstances will be considered at the discretion of the NFRCC on a case-by-case basis.
